VIA MEMBERSHIP PROGRAM: TERMS AND CONDITIONS
I. DEFINITIONS
1. "VIA" means EBIX Travels Private Limited (formerly known as FlightRaja Travels Private Limited), incorporated in 2006 and having its registered office at Magnolia, Level 4, Block B, Manyata Embassy Business Park, Nagawara, Bangalore 560 045
2. "VIA Members" means customers who have become members of VIA by giving their personal details. The cards that they hold are referred to as "VIA Membership Cards" or "Membership" or "Cards"
4. "Membership Fee" means the Annual Fee of enrolment
5. "VIA product" or "Product" means any travel (flights/ bus/ hotels/ holidays) that is sold on the VIA portal (www.via.com) or through any travel agent (where the agent in turn has purchased the travel from the VIA Agent portal (www.viaworld.in/agent).
6. "Membership Rewards Program" or "Program" or "Membership Redemption" or "Redemption" means the loyalty program of VIA wherein members accumulate Points from their spending on a VIA product as determined by VIA from time to time.
7. "VIA Points" or "Points" means the points accrued through the Program when a customer has transacted on a VIA Product through www.via.com, directly.
8. "VIA Bonus Points" or "Bonus Points" means the points accrued through the Program when a customer has transacted on a VIA Product through a VIA travel Agent.
II. ELIGIBILITY & ENROLLMENT
1. Participation in the Program is open to all customers residing in India who have an Indian Rupee billed credit/ debit Card or Net Banking account.
2. Enrollment can happen through www.via.com, VIA Travel Agents, authorised VIA Alliance Partners/ Affiliates, Corporate houses and VIA Sales staff.
3. On enrollment, members are required to pay the applicable annual fee for the Program.
III. POINTS EARNED IN THE PROGRAM
1. a.
Subject to 1(d) and 1 (e) below, every VIA member enrolled in the Program will accrue points on all transactions of VIA products. The number of products accrued on any transaction will be defined by VIA from time to time and will solely be the decision of VIA. In addition, VIA may, at its sole discretion, increase or decrease the accrual of the number of points on any transaction.

Customers may either get VIA Points or VIA Bonus points on their transaction. The kind of points (VIA Points or VIA Bonus Points) that they get is dependent on how the transaction is carried out (through www.via.com or the Agent) AND on the product transacted on (Flights/ Bus/ Rail etc.).

Defining the kind of points that a customer gets (VIA Points or VIA Bonus Points) is at the sole discretion of VIA.

From time to time VIA may run promotional offers or special schemes on some products. VIA points or VIA Bonus points will not be awarded on these promotional offers and schemes.

VIA may also decide to withhold granting VIA Points or VIA Bonus Points on a few products from time to time.
2. A member can earn VIA points when he is transacting on www.via.com when he is making a booking for others as well. However, the member should clearly mention his membership number in such cases.
3. When making a booking through an Agent, a member earns VIA Bonus points only if he or she is a part of the travel booking made by the Agent. In these cases, members have to ensure that the name given in the travel booking has to match with the name given for the membership program. VIA has the right to refuse awarding Bonus Points if the name given for travel and that in membership does not match. It is also the responsibility of the customer to ensure that the name matches in the two events.
4. Points accrued in the membership program do not constitute any property of the member and are not transferable by operation of law or otherwise to any other person or entity and cannot be transferred to, or combined with, any other membership card.
5. Adjustment will be made to the Points accrued in the Cardmember's Program Account if there is any credit(s), including those arising from returned goods or services or billing disputes, or debit(s) posted to a Cardmember's Account.
IV. NOTICE OF ACCUMULATED POINTS
Member's statement of accounts will be available on www.via.com, in the member's account. The member will have to access his account with his membership id/ password to access the statement.
V. POINTS REDEMPTION
1. VIA points can be redeemed on www.via.com on a few products. The products on which the VIA Points can be redeemed are Flights, Hotels, Holidays and Buses.
2. Even within the products mentioned in V. 1., VIA may remove the redemption option on some specific flights, hotels, holidays or bus sectors, at its sole discretion.
3. VIA points CANNOT be redeemed on Rail
4. Apart from the products mentioned in V.1. above, VIA may from time to time offer members the option of redeeming points with Alliance partners. This redemption, however, will be time-bound and redemption needs to happen in the specific period as mentioned by the Alliance partner.
5. VIA Bonus Points can be redeemed on VIA Mall.
6. Members can seek the help of a VIA travel Agent to redeem their bonus points on the VIA Mall, which is available on the VIA Agent Portal.
7. From time to time, VIA will also offer point redemption for bonus points on some select travel products.
8. Redeemed rewards are not exchangeable for other rewards, or refundable, replaceable, or transferable for cash or credit under any circumstances.
9. VIA Poinst or Bonus points cannot be redeemed or exchanged for cash.
10. Once accrued Points/ Bonus Points in a member's account have been redeemed, such Points or Bonus Points cannot be transferred back into the member's Account.
11. Information supplied on the redemption of certain rewards may be used by VIA for administrative and marketing purposes.
12. Most importantly, on ANY transaction in which a member is redeeming Points or Bonus Points, he or she will not be eligible to earn points for the sme transaction. In other words, on any transaction one can either earn points or redeem points, not both.
VI. REDEEMING TRAVEL AND OTHER REWARDS
1. All rewards are subject to availability and certain restrictions, which may apply.
2. Any additional meals, transportation, accommodation arrangements or any other incidental expenses made in connection with any Reward will be the sole responsibility of the member.
3. Issuance of a dining, travel or hotel certificate does not constitute a reservation. The member
is responsible for making all reservations and notifying the participating Service Establishments of
the Reward(s) they are going to redeem.
4. From time to time, there could be various offers and deals given by participating service/ product establishments to VIA members. These offers are given on a 'goodwill' basis and VIA shall carry no liability on 3rd party offers on the card. Nor shall VIA be responsible for the deal being honoured in letter and spirit by the 3rd party associate.
VII. GENERAL
1. Pictures or any artwork shown in Membership Rewards Catalogue is only indicative of the Reward. Actual Rewards may vary.
2. The member is solely responsible for any Govt. tax, duty or other charge imposed by law in any country in respect of the Program, Participation in the Program and any Points converted or acquired or any other transaction within the Program.
3. By redeeming a Reward, the member releases VIA, its affiliates, subsidiaries, parent or
group companies from any and all liabilities to the members or any guests of the members
regarding the redemption or use of any Rewards, or other participation in the Program.
4. All questions or disputes regarding eligibility for the Program or eligibility for Points for accrual or
redemption of rewards will be determined by VIA at its sole discretion.
6. The Membership Program is being brought by VIA on a "best effort" basis. The features
against every redemption option has been provided by the respective partner, in VIA malls. VIA is not in a position to validate or authenticate such claims and shall take no responsibility for the same.
7. Fraud and abuse relating to the earning of Points in the Program or redemption of rewards
may, at the discretion of VIA, result in forfeiture of accrued Points, as well as cancellation of a member's membership account.
8. VIA reserves the right to cancel, change or substitute any Reward or Program Terms and
Conditions at any time, at its sole discretion without prior notice.
9. VIA can suspend or terminate the Program at any time it deems necessary. In such a case, VIA shall give advance written notice to members in the manner it deems appropriate.
10. All disputes arising out of this program shall be subject to the exclusive jurisdiction of competent courts in Bangalore.
